【摘要】文章分析發(fā)現(xiàn)全國4個直轄市、49個"較大的市"的《城市地下空間開發(fā)利用管理辦法》在文件層級、基本概念、適用地域和內(nèi)容設(shè)置等方面存在制訂爭議?；诜ɡ韺W(xué)認知,文章提出《城市地下空間開發(fā)利用管理辦法》的制訂建議:以高位階的地方性法規(guī)或地方政府規(guī)章為文件發(fā)布層級,以"城市規(guī)劃區(qū)"為適用地域,以綜合性、程序性規(guī)則為主要設(shè)置內(nèi)容,以凸顯地下空間管控特色為核心和靈魂,以期能幫助提高各地制訂《城市地下空間開發(fā)利用管理辦法》的專業(yè)水準。
【Abstract】 The paper summarizes "Urban Underground Space Development Administration Measure" across 4 municipalities and 49 "large cities" in China, and points out several dispute in the document level, the basic concept, the applicable area, the chapter structure and specific content. Based on jurisprudential understanding of local laws and local underground space development regulatory system, the paper gives several recommendations on improving existing regulations, taking the normative document as high level, the city(or county) government as regulators, applying the regulations to the city planning area, laying a comprehensive procedural rules on local urban underground space development as the main content, stressing local concerns.
